Many states now require contractors to offer a written Warranty. For instance, Oregon CCB requires a warranty be offered for all contracts to build a new residential structure.  ORS701.320. The warranty must be presented simultaneously with a contract for construction.

Regardless of the Law, builders need to show their clients what they warrant and what they do not warrant. Does the builder need to replace a driveway with a hairline crack? Can the homeowner be assured their contractor will repair a loose handrail or a leaky roof? How often should the furnace filter be changed?
