Many States now require contractors to offer a written Warranty. For instance, Oregon CCB requires a warranty be offered for all contracts to build a new residential structure. ORS701.320. The law does not require a specific time for warranty protection. A typical new home warranty protects against structural defects for five to ten years and promises to repair or replace major systems for one to two years. The contractor may select the time period the contractor feels is appropriate for the warranty. The warranty must be presented prior to entering into a contract for construction. Oregon Law also says the contractor must furnish a maintenance schedule with every home they build. This Homeowners Manual complies with the law, which is advisable to supply to the homeowner regardless of what state you are in.
Oregon law says the contractor can charge a fee for his warranty. The contractor has to offer the warranty but the owner does not have to accept it. Our publication provides for this.
The limited warranty and homeowner’s manual should become an integral part of your contract. Your warranty corrections personnel need to take this manual with them on every call back.
Regardless of the Law, builders need to show their clients what they warrant and what they do not warrant. Does the builder need to replace a driveway with a hairline crack? What causes and who is responsible for efflorescence? Answers to this and others can be found in the Home Owners Manual.
Builders need to show a maintenance schedule to comply within the limits of their warranty and ORS 701.335 and OAR 812-001-0240 and ORS 701.320. There is a maintenance schedule included in our publication.
Builders need to supply a care and maintenance program to their clients. How do they take care of their Hot Water Heater? What about ice melt on the sidewalk?
Clients need to understand New Home construction guidelines during the construction period. Is it their position to dictate to your employees or sub-contractors or crawl around on the Roof?
There are warranties offered from numerous Insurance Companies. Few, if any of them have a detailed warranty showing complete maintenance and where to draw the line on what is covered or any kind of a maintenance program. How many Insurance Company Warranties tell you that their warranty does not cover structural defects? Most Insurance Company Warranties only cover appliances.
